Clark Boats - Warranty
The Trustee for Clark Aluminium Boats Trust trading as Clark Aluminium Boats accepts liability for Clark Aluminium Boats of our OWN manufacturer (i.e. boats made after 01-10-2010 with a HIN: AU-CLB). Clark Aluminium Boats Hulls are warranted to the original purchaser to be free of defects in materials and workmanship for a period of two years (24 months) from the date of purchase. Note: upholstery, seat fittings, windscreens, striping, wooden floors, hatches, accessory products supplied by Clark Aluminium Boats, fuel tanks and sender units are limited to a twelve month warranty only; - it is a general warranty as to the fitness for the purpose of these products. This warranty is not transferable or capable of assignment by the original purchaser to a third party. Our liability is limited to making good any defects, at our discretion by repairing or replacing the same at the Clark Aluminium Boats factory, with freight pre-paid, provided that:
Special Provisions
- The warranties herein contained extend to the original purchaser (whose details are recorded by Clark Aluminium Boats) only, and is subject to proof of purchase and the date of purchase to which Clark Aluminium Boats records must be conclusive in case of disagreement.
- The boat must, at all times have been used and maintained in the accordance with the Australian Builders Plate (aka Boat Capacity Plate) attached to the boat as well as the “Boat Care Instructions” listed below.
- The boat or outboard engine must not have been modified, altered or operated outside safe boating practises or the limits of the original design specifications.
- The boat has not been damaged by neglect, accident or misuse or used for competitive or commercial purposes. Clark Aluminium Boats does not certify their boats as suitable for commercial application.
- The paint warranty is limited to defective paint or application only. NOT against the normal effect of wear and tear, solvents, fuel damage or the normal effect of oxidization and degradation caused by dissimilar metals. Oxidisation has the potential to bubble the paint finish. Surface contaminates can cause oxidisation if not removed from the vessel.
- Clark Aluminium Boats shall not be liable for consequential loss of any kind arising out of the supply, operation or use of the boat.
- Clark Aluminium Boats does not cover any consequential expenses beyond the warranty repair of the boat itself, e.g. freighting.
- Any work agreed to be repaired by Clark Aluminium Boats will be done ex-factory, and freighting costs to and from the factory will be the purchasers responsibility. The warranty does not cover items replaced during normal service and maintenance operations which are subject to wear.
- This warranty is in lieu of all and any warranties expressed or implied, conferred by statute or otherwise and is intended to cover all warranties given by the company on the boat or part thereof.
- This warranty is not intended to affect the owner's rights under the law of any State or the Trade Practices Act or Sale of Goods Act. Any such warranties under the Trade Practices Act or Sale of Goods Act as are inconsistent with the terms of this warranty are expressly negated.
- All warranties and conditions implied under the Trade Practices Act, including as to one of merchantable quality, are not excluded by this warranty except that Clark Aluminium Boats limits its liability for breach to:
- the replacement of the boats products; or
- the repair of the boat or products
at Clark Aluminium Boats option, with all freighting costs to be the purchasers responsibility. - Clark Aluminium Boats will NOT warrant boats which have been improperly trailered. E.g., the use of multi roller trailers, incorrect or insufficient tie down from vessel to trailer, no engine support through an engine support bracket and or off road use.
- Excludes windscreen/windshield breakage and leakage around windscreens/windshields or other designed openings.
Commercial Use
Clark Aluminium Boats do not warrant Clark Aluminium Boats that are used commercially or warrant that Clark Boats are suitable for any particular commercial application.
Important
Clark Aluminium Boats is committed to a programme of continual product improvement and as such, reserves the right to modify or change materials, designs or specifications without notice.
The contents of the Clark Aluminium Boats website, excluding Warranty and Warranty Provisions, will not form part of any contractual agreement. Clark Aluminium Boats recommends that all boat owners comply with their local boating regulations and be familiar with safe boating practises.
Details referred to in the website are based on pre-production specifications and could be altered or deleted prior to the boat’s sale date. Because of variations which occur in manufactured products, all capacities, measurements, dimensions and weights quoted should be taken as approximate only and are subject to change without notice. Clark Aluminium Boats reserves the right to discontinue or change any of the exterior colours and interior trims without notice.
Boat Care Instructions
- Hose your boat off inside and out with fresh water after each use.
- Ensure that the bungs are removed & the boat is stored in a bow up tilted position to allow moisture in the hull to drain.
- Ensure that the interior of the boat is dry & left clean before storage.
- When the boat is not in use, the batteries should be disconnected or turned off at the isolator switch to avoid the possibility of electrolysis caused by any uncontrolled electrical currents.
- Do not stow wet lines in the boat as mould & mildew may result
- Use fresh water only to wash windscreen and clears.
- Inspect under floor floatation & fuel tank hoses & clamps annually. Tighten clamps as necessary. Inspect for lead sinkers and remove.
- Before using your boat, check bilge pump, navigation lights and electrics to ensure in working order.
- Where dissimilar metals contact apply a Duralac or similar product on a regular routine basis for prevention of electrolysis under paintwork.
